Puppy Contract & Purchase Agreement

DEPOSITS/PAYMENT/TRANSPORT

A $500 deposit for our pups will be required to hold your puppy. Puppies are reserved on a first deposit received basis. Deposits can be paid via money order, Chase Zelle, PayPal, or in cash. (NO EXCEPTIONS) Your puppy cannot be put on reserve before a deposit is received. Should a suitable puppy not be available from the litter, deposits will be honored on future litter(s) or refunded. Deposits are non-refundable if we have suitable puppies. We might have a waiting period of up to one year or greater for a replacement puppy depending on availability and planned breeding. If you change your mind and do not/cannot get the puppy; you will forfeit your deposit. We reserve the right to refuse or cancel the sale of a puppy at any time for any reason. In this event the Buyer will be refunded all of their money.

The puppy must be paid in full before you can take possession, 9 weeks old or older. If payment has not been made by 10 weeks, Windy Valley Frenchies will contact Buyer. Buyer will be given 72 hours to pay in full, or the Buyer may be given an opportunity to make suitable payment arrangements. Decisions about puppy/deposits paid and all other matters pertaining to said puppy will be at the sole discretion of Stiffler Bulldogs.

Puppy may be picked up after 9 weeks of age but before 12 weeks or Buyer will be charged a $25/week boarding fee in addition to any routine or emergency expenses the puppy may require until the time of pickup. Charges must be settled in full before puppy will be released into the Buyer’s care. Two weeks with no attempt to make pick up arrangements the Buyer forfeits puppy and any deposit or payments made on puppy, unless noted by Seller in writing.

Shipping is not available but meet ups are available and can be arranged by Windy Valley Frenchies at the Buyer’s request. Such costs are the responsibility of the Buyer and are not included in the agreed price of the puppy unless otherwise worked out when contract is signed. We have used a puppy nanny before which would be at Buyers expense.

The Seller agrees to furnish the Buyer with the necessary health information, including all shots and deworming records. The AKC temporary puppy limited registration papers will be provided to the Buyer once Seller has received Vet Check form filled out by vet and returned and confirmation of spay/neuter. The Buyer understands that this puppy will be eligible for limited registration with AKC and has been fully informed on how to go about the process of AKC registration. Also provided with Microchip #. Failure to return vet check form and confirmation of spay/neuter can and may result in the loss of ANY buyers’ rights and may result in the loss of your French bulldog.

PUPPY GUARANTEE

Puppy shall be in good physical condition at the time of pick up and thereafter. Your puppy has a one-year health guarantee and ends on this date of the following year.

The Buyer agrees to take puppy to a licensed Veterinarian for a complete physical examination within 15 days after receiving puppy. If the vet finds the puppy to have a serious physical conditions other than bacterial infection, such as Coccidia or Giardia, which is easily treated, the Seller will replace the puppy with another puppy of comparable quality, when available from same or upcoming litter, after the first puppy is returned to Seller. No money will be refunded. The Seller reserves the right for a second vet opinion at the expense of the Seller. If second opinion comes back with no problems the Buyer will pay back the Seller for vet bill plus forfeit any/all money and puppy. If a vet does not examine puppy within 15 days of delivery/pick up all guarantees are no longer in effect. The Buyer is required to supply Seller with a copy of the Vet Health Examination (Vet Check Form) within 7 days of the visit for the guarantees to be valid.

Puppy is guaranteed to be free from any genetic/hereditary defects that can cause death or serious impairment of vital functions in the puppy, until puppy is 1 year old. In the event your puppy develops an inheritable/genetic disease that is before his/her first birthday that is life threatening or causes serious impairment of vital functions, the Buyer is entitled to a replacement puppy of similar value or quality, when one becomes available. Arrangements must first be made to place diseased/impaired puppy back with Windy Valley Frenchie’s. For this guarantee to be valid, Windy Valley Frenchie’s requires medical records from a licensed Veterinarian in writing clearly documenting the diagnosis. We reserve the right to a second veterinary opinion. Your guarantee will be valid as long as the puppy gets all of its vaccinations on time and has all vet visits documented. Additionally, under no circumstances shall Windy Valley Frenchie’s be liable for veterinary expenses.

Puppies are at risk for Kennel Cough, Coccidia and Giardia, which are often associated with the stress of moving, a new home, new food, new people, change of climate or surroundings, etc. Due to the vast variety of causes, including environment, stress, and nutrition, skin conditions are not covered under this guarantee. This guarantee does not cover what may be considered “normal” for bulldogs or beyond our control such as: cherry eye, entropion, ectropion, dermatitis, loose hips, shoulders, or knees, elongated soft palate, or stenotic nares (loud sounding or "sniffing" when breathing), and hernias of all or any types. All of the above listed are correctable and will not adversely affect the French bulldog for any of its future pleasures.

Puppy will receive deworming treatments at 6 and 9 weeks and be inoculated with a first sets of vaccinations and any required there after until puppy is in its forever home. Full information about veterinary treatments will be provided. Your puppy will receive a vaccination against Parvovirus. It is the Buyer’s responsibility to complete the vaccination series. If puppy contracts a vaccinable illness once it leaves our care, no replacement puppy will be provided.

For the reasons of the type of breed, Windy Valley Frenchie’s strongly suggests doing your research and insuring puppy with a reputable Pet Insurance company (like AKC). If the Buyer elects to forego Pet Insurance, the Buyer agrees that puppy shall never be euthanized or given substandard medical care as a result of the Buyer’s financial circumstances. Any serious or life-threatening ailment that cannot be treated as recommended by a veterinarian, will necessitate the return of puppy to Windy Valley Frenchie’s

Seller assumes no liability in the event of any accidents involved with your dog including but not limited to dog bits or personal/property damage. Seller suggests proper socialization and training is given to benefit the dog and owner.

The seller has informed us of any health concerns in writing for said puppy. This document is attached to this Purchase Agreement.

THE BUYER AGREES TO THE FOLLOWING:

This puppy is to be registered with {AKC}. Puppy temporary registration papers will be released to the Buyer when Seller receives the Vet Check Form and confirmation of spay or neuter

The puppy comes with a microchip that will be required to be registered under buyer’s name with Jill Madrid information being put as second contact. If you fail to do so you forfeit the health guaranty. If at any time we get contacted on puppy being found, we will contact buyer to try to get puppy back to buyer. If this occurs 3 times, puppy will be forfeited on the 3rd time back to seller.

The puppy cannot be given away or sold to any other individual or research company without written consent of Windy Valley Frenchie’s. The Buyer certifies that they are not acting as an agent for another individual in the purchase of this puppy and will not resell this dog to any type of mass-producing business or “puppy mill”. In the event the Buyer cannot keep puppy or provide proper care for the puppy, the puppy will be returned to Windy Valley Frenchie’s. Buyer must not euthanize, take puppy to an animal shelter, or breed rescue.

The Buyer is buying the puppy as a pet, the Buyer shall ensure puppy is spayed or neutered, not sooner than 6 months of age and not later than 18 months of age, unless deemed medically necessary by a licensed veterinarian. Buyer is required to send documentation within 7 days from date of spayed/neuter to seller. The buyer agrees to sign a spay/ neuter contract that also must be followed.

The buyer agrees the puppy will never be abused, neglected, or used for any kind of illegal purposes. Buyer also agrees to provide proper shelter, food, water, and never leave the puppy on a chain for extended periods of time (no more than 10 mins unsupervised). Puppy is not to ever be left to live in a cage or outside. Buyer also commits to provide necessary veterinary check-ups, vaccinations, worming, and heart preventative as recommended by a licensed veterinarian. If the puppy shows signs of neglect or abuse, ownership of the puppy will immediately return to Windy Valley Frenchie’s without any return of money to the buyer.

The terms of this contract last the puppy’s entire life and failure to abide by the conditions set forth in this contract or in any way to neglect the emotional or physical well-being of said puppy will result in Windy Valley Frenchie’s taking ownership of dog and/or civil litigation, without any refunds of money paid for puppy. The buyer will be responsible for all civil litigation fees for seller and buyer

The Buyer agrees to stay in contact with Seller by email, phone, and Facebook for the whole duration of said puppy’s life. The Buyer agrees to join the group Windy Valley Frenchie’s Parents on Facebook and post updates and pictures on a monthly basis at the least. The Buyer agrees to let Seller do scheduled and surprise home checks to make sure the pup is being cared for properly for the whole duration of puppy’s life. The Buyer agrees that at any time the buyer moves or changes any contact information, that the Buyer will contact Seller with the new contact information.

By signing below both parties agree to fulfill the terms set forth in the contract.

Notes from seller: This breed has a lot of breathing problems. Please do your research on this breed. Anytime you have questions or concerns please feel free to contact us. I will be sending with you a list of recommended food, toys, and accessories. Please keep all your records on said puppy together in a safe place.

CALIFORNIA PET LEMON LAW

AMOUNT OF TIME REMEDY IS AVAILABLE:

  • 15 days for illness or disease
  • 1 year for congenital or hereditary defects
  • (Citation: West's Ann. Cal. Health & Safety Code § 122070)

REMEDIES:

  1. Replacement plus reimbursement for veterinary expenses related to diagnosis and treatment, up to the purchase price of the dog
  2. Refund of purchase price plus reimbursement for veterinary expenses up to the purchase price of the dog
  3. Reimbursement of veterinary expenses up to 150% of the purchase price of the dog

ENFORCEMENT AGENCY CONTACT:

"An action may be prosecuted in the name of the people of the State of California by the district attorney for the county where the violation occurred in the appropriate court or by the city attorney in the city where the violation occurred." (West's Ann. Cal. Health & Safety Code § 122095)
